These Terms of Service ("Terms") govern your use of mysmartlivingtools.com, the MySmartLivingTools browser apps, and anything you buy from us. MySmartLivingTools is a brand operated by DIGINETWORK LLC, a Wyoming limited liability company ("we", "us", "our").
By creating an account, placing an order or using our apps, you agree to these Terms, our Privacy Policy, our Refund & Cancellation Policy and our Delivery Policy. If you do not agree, please do not buy or use our products.
1. Who we are and how to reach us
- Legal name: DIGINETWORK LLC (doing business as MySmartLivingTools)
- Address: 30 N Gould St Ste R, Sheridan, WY 82801, United States
- Email: hello@mysmartlivingtools.com — we reply within one business day
- Contact form: mysmartlivingtools.com/contact
2. What we sell
We sell two kinds of things:
- Digital products — browser apps (for example the ADHD Budget Planner, the Debt Payoff Tracker and the Invoice Tracker) that open in a web browser, can be added to your home screen and work offline. Each purchase includes access to the app, a product key, a setup guide (PDF) and, where stated on the product page, an offline copy. Nothing physical is shipped.
- Custom builds — a tracking system (Google Sheets, Excel or Notion) that we design for you on request. Section 8 covers these.
Each product page describes what is included, the format, and the devices and browsers it works with. Please read it before you buy.
3. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to buy from us. Our products are not directed to children.
You can buy without an account. If you create one, keep your password private and tell us straight away if you think someone else has used your account. You are responsible for activity under your account. We may suspend or close an account that is used for fraud, abuse or a breach of these Terms.
4. Prices, payment and taxes
- All prices are shown and charged in US dollars (USD). If your card is in another currency, your bank may add conversion fees.
- Payments are processed by Stripe, Inc. Your card details are entered on Stripe's secure, PCI-DSS-compliant checkout and never reach our servers.
- Where sales tax, VAT or similar tax applies, it is calculated and shown at checkout before you pay.
- The price shown at checkout is the price you pay. We may change prices at any time; a change never affects an order you have already paid for.
- If we find an obvious pricing error, we may cancel the order and refund you in full before or after delivery.
5. Sales, discounts and promotions
- A crossed-out price shows the product's regular list price. A sale price applies only to orders completed while the sale is shown on the site.
- Discount codes are single-use unless stated otherwise, cannot be exchanged for cash, cannot be combined with another code, and cannot be applied to past orders.
- If a price drops after you buy, we do not refund the difference.
- Any promotion with extra conditions (for example an end date or a bundle requirement) states those conditions next to the offer.
6. Delivery
Digital products are delivered electronically: your setup guide with your app link and product key appears on the confirmation page as soon as Stripe confirms payment, and a copy is emailed to the address you paid with. Full details, including what to do if nothing arrives, are in our Delivery Policy.
7. Your licence
When you buy a digital product you receive a licence to use it, not ownership of the software, design or content. We (or our licensors) keep all intellectual property rights.
7.1 What your licence allows
- Personal and household products (for example the ADHD Budget Planner and Debt Payoff Tracker): use by you and the members of your household.
- Business products (for example the Invoice Tracker): use by one business — you, as a sole trader or freelancer, or one company — for its own internal operations.
- Use your product key on all of your own devices (phone, tablet, computer).
- Print, export and keep the data and documents you create with the app (for example invoices, plans or CSV exports). That data is yours.
- Receive updates to the product that we release while we continue to offer it (see section 9).
7.2 What it does not allow
- Sharing, publishing, selling, giving away or otherwise distributing your product key, app link, offline copy or setup guide.
- Reselling, sublicensing or offering the product, or a modified copy of it, as your own product or as part of a paid service.
- Copying, decompiling or reverse-engineering the app, or removing or bypassing the product-key check, except where the law expressly allows it.
- Using a product in a way that breaks the law.
If a product key is shared publicly or used in breach of this licence, your licence ends, and we may block that key in future versions of the app and refuse further updates or support for it. For team or multi-business use, email us first.
8. Custom builds
- Quote and start. After you send a request we reply within one business day. We confirm the scope, price and estimated delivery date in writing (by email) before any payment is taken or work begins. Prices on the Custom build page ($49 Personal, $149 Business) are starting prices for a standard build; bespoke builds are quoted individually.
- Payment. Custom builds are paid in full through Stripe before work starts, unless your written quote says otherwise.
- Revisions. Each build includes two (2) rounds of revisions within the agreed scope, requested within 30 days of delivery. Changes that go beyond the agreed scope are quoted separately.
- Delivery. Estimated times are given in your quote (typically a few days for Personal builds and about a week for Business builds). They are estimates, not guarantees, and depend on you answering our questions.
- Ownership. Once paid in full, the finished file is yours to use and edit for your own personal or business purposes. You may not resell it as a template. We may reuse general techniques and non-identifying structures, but never your data or business information.
- Your information. Do not send us passwords, card numbers or other highly sensitive data as part of a request. Use sample figures where you can.
- Cancellation and refunds for custom builds are covered in our Refund & Cancellation Policy.
9. Updates and "lifetime" access
"Lifetime access" and "free updates" mean: for as long as we continue to offer and maintain the product, you get every update to the product you bought at no extra cost. Updates may add, change or remove features. We do not charge again for an update to a product you own.
If we ever stop offering a product, we will give at least 30 days' notice by email to the address you bought with, and you will be able to keep using the version you already have and export all of your data.
10. Your data and backups
Our browser apps store what you type only on your own device, in your browser's storage. We cannot see, recover or restore it. Clearing your browser's site data, uninstalling the app, resetting or losing a device can erase your entries permanently. You are responsible for keeping backups using the backup and export features built into each app.
11. Not financial, legal or tax advice
Our products are organisational tools. Figures such as a "safe to spend" amount, a debt-free date, interest estimates or invoice totals are calculations based entirely on the numbers you enter and the assumptions described in the app. They are not financial, credit, debt-counselling, accounting, legal or tax advice. Check important decisions with a qualified professional. The Invoice Tracker is not accounting software and does not file taxes for you.
12. Reviews and content you submit
Reviews must be honest, based on your own experience, and civil. Only upload photos you have the right to share and that do not show other people without their permission. Reviews are checked by a person before they appear. We publish positive and negative reviews alike, and we remove only content that is abusive, off-topic, unlawful, contains personal data, or is clearly not about the product. By submitting a review you grant us a non-exclusive, royalty-free, worldwide licence to display it on our site and in our marketing. We never pay for reviews or offer anything in exchange for a positive one.
13. Acceptable use
You agree not to: attempt to break into, overload or disrupt the site or checkout; test stolen or unauthorised payment cards; scrape the site at scale; upload malware; or use the site to harass others or break the law. We may block access and cancel orders connected with fraud.
14. Warranty
We promise that each digital product will work substantially as described on its product page on the devices and browsers listed there. If it does not, contact us: we will fix it or refund you under our Refund Policy. Apart from that promise, and to the fullest extent the law allows, the site and products are provided "as is" and "as available", without other warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will always be available or error-free. Nothing in these Terms removes rights you have under consumer-protection laws that cannot be excluded.
15. Limitation of liability
To the fullest extent the law allows: (a) we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or financial decisions made using our products; and (b) our total liability for any claim relating to a product or these Terms is limited to the amount you paid us for that product in the 12 months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
16. Indemnity
If you use a product in breach of these Terms or the law (for example by redistributing it), you agree to cover reasonable costs and losses we incur as a result.
17. Legal and export restrictions
You may not buy or use our products if you are located in, or ordinarily resident in, a country or region subject to comprehensive U.S. sanctions, or if you appear on a U.S. government restricted-party list. We may refuse or cancel orders to comply with these laws.
18. Disputes and governing law
Talk to us first. Most problems are solved in one email. Before filing a chargeback or legal claim, please write to hello@mysmartlivingtools.com with your order number (it starts with MSL-) and give us 14 days to put it right.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Any claim not resolved informally will be heard in the state or federal courts located in Wyoming, except that either party may bring a claim in small-claims court where it qualifies. If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of your country of residence.
19. Changes to these Terms
We may update these Terms. The current version is always on this page with its "Last updated" date. Changes apply to orders placed after that date; the Terms in force when you bought a product continue to apply to that purchase.
20. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. These Terms, together with the policies linked above, are the whole agreement between you and us about our site and products.
